Real Estate & Construction Litigation
CRAWFORD, WISHNEW & LANG represents clients in real estate and construction litigation, including title disputes, HOA disputes, construction defect cases and disputes by and between real estate developers and commercial brokers. Our representations include:
-Several mineral interest owners in a dispute involving a cloud of title that arose when JPMorgan Chase Bank leased property belonging to the clients. Obtained summary judgment against the bank and quieted our clients’ title to mineral rights in 200 acres in the Eagle Ford Shale.
-An international commercial real estate company in defense of claims for fraud, negligent misrepresentation and negligence relating to the plaintiff’s inability to lease a specific commercial property. Settled case in the client’s favor after depositions for less than nuisance value.
-A real estate developer in a construction defect case concerning a 200-acre mixed-use development. Obtained an eight-figure settlement on the client's behalf.
-An international commercial real estate company in a case involving a breach of contract claim brought against the client relating to a letter of intent. The plaintiff dismissed the case against the client with prejudice after depositions.
-A Fortune 500 company in defense of case involving nationwide construction, several thousand work sites and millions of allegedly unpaid change orders. Negotiated an 11th-hour settlement for far less than half of the amount initially demanded.
-More than a dozen homeowners in a real property dispute against a national commercial real estate developer who the jury found to be violating numerous restrictive covenants in an attempt to circumvent the clients' real property rights, titles, and interests.
