Dave is a trial lawyer and business counselor that protects and pursues his clients’ interests. Dave’s diverse litigation practice focuses on complex commercial, employment and intellectual property litigation in state and federal courts, and administrative forums in Texas and across the country.  Dave's clients include individuals and businesses of all types and sizes, mostly based in Texas or with operations in our state, including Fortune 500 companies, professional athletes, doctors, lawyers, and executives, local breweries and distilleries, venture capital and private equity funds, telecommunications, marketing and multi-media, staffing and executive placement, restaurants and music venues, jewelry manufacturing and repair, and a variety of small businesses. 

News agencies across the country published stories of Dave’s client, wedding photographer Andrea Polito, after prevailing in a defamation case against two former clients who pursued an extensive news and social media campaign against her. A Dallas County jury found the defendants liable for defamation, disparagement, and civil conspiracy, and awarded Andrea a substantial verdict which included punitive damages. “Freedom of speech is not freedom from consequence...nobody is challenging your right to post a review or your free speech rights but with those rights come consequences,” told to the jury and the Associated Press by Dave, who tried the case with TJ Jones.  The story was covered by hundreds of publications, including the New York Times, CBS News, The Washington Post, Dallas Morning News, New York Post, Huffington Post, People Magazine, and the U.S. News & World Report. Dave and Andrea also appeared on various television outlets, including CNN and Inside Edition.

In addition to his trial practice, Dave serves as outside general counsel to several businesses.  In this capacity, he has negotiated contracts and large distribution agreements, employment and severance agreements, and conducted regulatory compliance investigations. Dave has substantial experience with issues related to employment contracts – and is a contributing author to the Texas Lawyer published book, Texas Litigators’ Guide to Departing Employee Cases.  

Dave has earned a reputation for finding solutions that avoid disputes when possible, and handling them efficiently and aggressively when necessary.
